Restoration of Wetlands Covered by SEPP 14

State Environmental Planning Policy No 14 – Coastal Wetlands (SEPP 14) applies to many wetlands on the coast of NSW. The Policy is designed to protect wetlands from ad hoc clearing, draining, filling and levee construction. Where a development is proposed to involve clearing, draining, filling or the construction of a levee, preparation of an environmental impact statement is required to be approved by the local Council and the Department of Planning.
Similarly, restoration works that involve clearing, draining, filling or the construction of levees, require an approved EIS in relation to the works before the restoration can proceed.
Wetland restoration works can have far reaching effects that influence land well away from the restoration site. The requirement for an EIS ensures that the surrounding environment and neighbours are considered, and allows interested parties to have a say on the proposed works.
Works undertaken in contravention to SEPP 14 are considered a breach of the Policy and restoration orders can be issued or monetary penalties applied. It is possible that works undertaken to restore a breach of SEPP 14 be undertaken without the preparation of an EIS. Preparation of a ‘Restoration Plan’ can replace the requirement for an EIS for minor breaches of the Policy.
